1. Who we are
NamedTest is a self-serve web app at namedtest.com. It is operated by NamedTest LLC, a Missouri limited liability company ("NamedTest," "we," "us"). These Terms are a contract between you and NamedTest LLC. By buying a report, starting a subscription, or using the site, you agree to these Terms. If you do not agree, please do not use NamedTest.
2. Who can use NamedTest
You must be at least 18 and able to enter a contract. If you buy on behalf of a business, you confirm you are allowed to bind that business to these Terms.
3. What NamedTest does
NamedTest sends prompts to third-party AI systems and records which businesses those systems name in their answers. Your report describes the answers we received on the date the report was run (the "run date"). We do not own, control, or influence those AI systems.
4. AI answers change
AI systems change their answers often, sometimes daily. The same prompt can produce a different answer an hour later, on another day, for another user, or in another location. Your report is a snapshot of the run date only. It is not a prediction of future answers and it may not match what you or your customers see.
5. No guarantee of placement or results
We do not guarantee that any AI system will name, rank, recommend, or describe your business in any way. We do not guarantee more customers, calls, traffic, revenue, or any other result. Any suggestions in a report are general information that you choose whether to use.
6. Accuracy
We report AI answers as we received them. AI answers can be wrong, outdated, or incomplete, and we do not verify them. We try to record and summarize answers accurately, but our reports may contain errors.
7. Your account and inputs
You are responsible for the information you enter, such as a business name, city, website, trade, or competitor names. Please only enter information you have the right to use. You may not use NamedTest to harass anyone, to impersonate a business, or to break any law. We may refuse service or end access if you misuse NamedTest.
8. Purchases and subscriptions
Prices are shown at checkout in U.S. dollars. One-time reports are charged when you buy. Subscriptions renew automatically at the end of each billing period at the price shown when you signed up until you cancel. Payments are processed by Stripe. We do not store your full card number.
9. Canceling a subscription
You can cancel anytime using the cancel link in any NamedTest email. Cancellation stops future charges. You keep access until the end of the period you already paid for. Refunds are covered in the Refund Policy.
10. Price changes
We may change prices. A change will not affect a period you already paid for. We will email subscribers before a new price applies to them.
11. The public AI Visibility Index
We publish a public AI Visibility Index. It shows which businesses AI systems named in response to prompts we write and run ourselves. The Index contains no data submitted by customers and no information from private reports. A business may appear in the Index because an AI system named it, whether or not that business uses NamedTest. Appearing or not appearing in the Index is not an endorsement or a rating by NamedTest.
12. Our property
NamedTest, its site, software, methods, and the Index belong to NamedTest LLC. You may use your reports for your own business, including sharing them with your staff, agency, or advisors. You may not resell reports, scrape the site, or copy the Index in bulk without our written permission.
13. Third-party AI systems
NamedTest relies on AI systems run by other companies. Their terms, outages, and changes are outside our control. If a provider changes or stops access, we may change or stop parts of NamedTest.
14. Disclaimer of warranties
NamedTest is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
15. Limit of liability
To the extent the law allows, NamedTest LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
16. Indemnity
If you misuse NamedTest or break these Terms and someone makes a claim against us because of it, you agree to cover our reasonable costs from that claim.
17. Governing law and disputes
These Terms are governed by the laws of the State of Missouri, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in St. Louis County, Missouri, and you consent to their jurisdiction. Before filing a claim, please email us so we can try to resolve it informally.
18. Changes to these Terms
We may update these Terms. We will post the new version with a new effective date. If a change is material, we will email active subscribers before it takes effect. Continuing to use NamedTest after the effective date means you accept the change.
19. General
If any part of these Terms is unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. You may not transfer these Terms without our consent. These Terms, the Privacy Policy, and the Refund Policy are the whole agreement between you and us.
